1.Nature of the service
Celsmar is a financial-markets information and analysis platform for informational and educational purposes only. All of its content — quotes, fundamentals, valuation models, quantitative signals, calendars, news, AI-generated analysis, analyst consensus and any other feature — is provided on a general basis, without regard to your investment objectives, financial situation, knowledge, experience or risk tolerance.
2.We do not provide investment advice
Celsmar is not an investment services firm, credit institution, broker or securities dealer. We are not authorised, registered or supervised by the Spanish Comisión Nacional del Mercado de Valores (CNMV) or any other financial regulator, and we provide none of the investment services set out in Spanish Law 6/2023 on Securities Markets and Investment Services or Directive 2014/65/EU (MiFID II). In particular:
- We do not provide investment advice or issue personal recommendations.
- We do not receive, transmit or execute buy or sell orders.
- We do not manage third-party portfolios or hold client funds or financial instruments. Celsmar's "portfolio" features are an informational record of positions you enter yourself; they involve no custody or management whatsoever.
3.Content is not an investment recommendation
Celsmar content (including AI-generated analysis, quantitative signals, DCF models and third-party analyst consensus data) does not constitute an "investment recommendation" within the meaning of Article 3(1)(35) of Regulation (EU) No 596/2014 on market abuse (MAR), nor investment research or financial analysis under MiFID II. It has not been prepared in accordance with legal requirements designed to promote the independence and objectivity of investment research, and it is not subject to any prohibition on dealing ahead of its dissemination.
Likewise, nothing in the service constitutes an offer, invitation or solicitation to buy or sell financial instruments, or tax, accounting or legal advice, in any jurisdiction. The service is not directed at persons in jurisdictions where its use would be contrary to law.
4.Investment risks
- Risk of loss: the value of investments can go down as well as up, and you may get back less than you invested or lose it all.
- Past performance: is not a reliable indicator of future results.
- Simulated results: backtests, projections and simulations (including Monte Carlo) are hypothetical, do not reflect real trades, and do not necessarily include fees, slippage or taxes. Hypothetical results have inherent limitations.
- Currency: investments denominated in a currency other than your own add exchange-rate risk.
- Crypto-assets: are extremely volatile, can lose all their value, are not always covered by investor-protection mechanisms and may be unsuitable for retail investors. See the CNMV and ESMA warnings on crypto-assets.
5.Third-party data
Information is obtained from public sources and data providers believed to be reliable (official registers such as SEC EDGAR, exchanges, aggregators and other third parties), but we do not independently verify all information and we do not guarantee its accuracy, completeness, timeliness or availability. Quotes may be delayed (typically 15 minutes or more, depending on market and source). All information is provided "as is".
Errors, interruptions or omissions in third-party data give rise to no liability for Celsmar, to the maximum extent permitted by law.
6.AI-generated content
Part of Celsmar's content (stock analysis, news summaries, explanations) is generated by artificial-intelligence language models. Such systems can produce incorrect, incomplete, outdated or outright fabricated information ("hallucinations"), even when it sounds convincing. AI-generated content is identified as such in the app, is not reviewed by human analysts, and should never be the sole basis for an investment decision.
7.Models and valuations
DCF valuations, quantitative scores, technical indicators and other model outputs depend critically on assumptions (growth rates, discount rates, margins, horizons). Small changes in assumptions produce very different results. A model-derived "fair value" is not a price target or a prediction; it is the arithmetic result of assumptions you can and should question.
8.Your decisions are yours
Any investment decision you make based on the service's information is solely your responsibility. Before investing, consider consulting an authorised financial adviser (you can check whether a firm is authorised in the CNMV public registers at cnmv.es, or with your local regulator), and read the prospectus and official documents of the relevant product.
9.Limitation of liability
To the maximum extent permitted by applicable law, Celsmar, its owners and collaborators shall not be liable for any loss or damage (including investment losses, loss of profit or indirect damages) arising from the use of, or inability to use, the service or from reliance on its content. Nothing above excludes liability for wilful misconduct or gross negligence, or affects non-waivable rights granted to you by consumer law.
10.Third-party content and links
The service displays news headlines and may link to third-party sites. We do not control and accept no responsibility for the content, policies or practices of such third parties.
