1.Who we are

Celsmar (“Celsmar”, “we”) is a financial-markets information and analysis platform operated from Madrid, Spain.

2.Purpose and acceptance

These Terms of use govern access to and use of the Celsmar website, application and services (together, the “Service”). By creating an account or using the Service you agree to be bound by these Terms, together with the Privacy policy and the Financial disclaimer, all of which form an integral part of them. If you do not agree, do not use the Service.

The Service is intended for people aged 18 or over. By registering you confirm that you meet this requirement.

3.Description of the Service

Celsmar is a financial information terminal offering, among other features: price quotes and history, company fundamentals, valuation models (such as discounted cash flow), quantitative signals, economic and earnings calendars, news, AI-generated analysis, portfolio tracking and watchlists.

Celsmar is strictly informational and educational. We are not an investment services firm, we do not execute buy or sell orders, we do not hold client funds or securities, and we do not provide financial advice. See the Financial disclaimer, which applies to all content in the Service.

4.User account

  • You need an account to use the Service. You agree to provide truthful information and keep it up to date.
  • Your account is personal and non-transferable. You are responsible for safeguarding your credentials and for all activity under your account.
  • If you detect unauthorised access, change your password and notify us at help@celsmar.com.
  • You can close your account at any time from My account, under Data. We may suspend or terminate accounts that breach these Terms, giving prior notice except in cases of serious breach.

5.Plans, pricing and payment

  • Celsmar offers a free plan and paid plans (Pro and Enterprise) whose features and prices are published on the pricing page. Prices may be shown excluding indirect taxes applicable in your country of residence.
  • Payments are processed by Stripe. Celsmar does not store your full card details.
  • Subscriptions renew automatically at the end of each period (monthly or annual) until cancelled. You can cancel at any time from your account; cancellation takes effect at the end of the paid period and you keep access until then.
  • The price you subscribe at stays the same for as long as your subscription remains active and uninterrupted: if we update our rates, the new price applies only to sign-ups made afterwards. If you cancel and subscribe again later, the rate in force at that time will apply.
  • Exceptionally we may have to change the price of an active subscription (for example, because of tax changes or the withdrawal of a plan). In that case we will notify you at least 30 days in advance and you may cancel before it takes effect.

6.Right of withdrawal

If you subscribe as a consumer resident in the European Union, you generally have 14 calendar days from purchase to withdraw from the contract without giving any reason.

  • Immediate start. Celsmar is digital content supplied online. Before you pay, we ask you to tick a box requesting that the service start immediately and acknowledging that you thereby lose your right of withdrawal. If you tick it, the right of withdrawal is lost as soon as you are given access to the plan, under Article 103(m) of the Spanish Consumer Protection Act. We confirm that consent by email together with the plan activation.
  • If you keep the right. If you have not given that consent, you may withdraw within the 14-day period. We will refund you within 14 calendar days of receiving your notice, using the same payment method you used, deducting where applicable the proportional part of the service already provided up to that point.
  • How to exercise it. Send a clear statement to [email protected]. You may use this model, although it is not mandatory: “I hereby give notice that I withdraw from my subscription to Celsmar [plan], purchased on [date], with the account [email]. Name and date”.
  • Cancelling renewal is different from withdrawal: you can do it at any time from My account and keep the plan until the end of the period already paid.

7.Acceptable use

When using the Service you agree not to:

  • Extract, harvest or download data in bulk or by automated means (scraping, crawlers, bots) outside the platform’s intended features.
  • Resell, redistribute, publish or sublicense the Service’s data, analysis or content, or use them to build a competing product or service.
  • Share your account or grant access to unauthorised third parties.
  • Circumvent technical protection measures, usage limits or plan restrictions.
  • Decompile, disassemble or reverse-engineer the software, except as mandatorily permitted by law.
  • Use the Service for unlawful purposes or in a way that damages, overloads or degrades the infrastructure.

Breach of this clause may result in immediate suspension or termination of your account, without prejudice to any other legal action.

8.Intellectual property

The platform, its code, design, brand, logos and original content are owned by Celsmar or its licensors and are protected by intellectual and industrial property law. Market data, quotes and third-party content belong to their respective owners (exchanges, public bodies, aggregators and data providers).

We grant you a limited, personal, revocable, non-exclusive and non-transferable licence to use the Service in accordance with these Terms. This licence gives you no ownership rights over the platform or the data.

9.Financial content

All content in the Service (including prices, fundamentals, valuations, quantitative signals, AI-generated analysis and analyst consensus) is informational and educational, does not constitute investment advice or a personal recommendation, and may contain errors or delays. Its use is governed by the Financial disclaimer. Any investment decision you make is solely your responsibility.

10.Availability and changes to the Service

The Service is provided “as is” and “as available”. We work to keep it running continuously, but we do not guarantee freedom from interruptions, errors or data loss, nor the permanent availability of any particular feature or data source. We may add, modify or remove features, and carry out scheduled or emergency maintenance.

11.Limitation of liability

To the maximum extent permitted by applicable law, Celsmar shall not be liable for: (a) investment losses or results arising from use of the Service’s information; (b) indirect damages, loss of profit or loss of business opportunities; (c) errors, delays or omissions in data supplied by third parties; or (d) damage caused by Service interruptions or events beyond our reasonable control.

Nothing above excludes or limits liability for wilful misconduct or gross negligence, or any rights granted to you by consumer law that cannot be waived. If you are a consumer, you retain all applicable statutory guarantees. In any event, Celsmar’s total aggregate liability is limited to the amount you paid for the Service in the 12 months preceding the event giving rise to the claim.

12.Data protection

The processing of your personal data is governed by our Privacy policy, drawn up in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD).

13.Changes to these Terms

We may update these Terms to reflect legal, technical or Service changes. If a change is material, we will notify you by email or through a prominent notice in the app with reasonable advance notice. Using the Service after the changes take effect constitutes acceptance; if you disagree, you may close your account before that date.

14.Governing law and jurisdiction

These Terms are governed by Spanish law. If you act as a consumer, this clause does not deprive you of the protection of the mandatory rules of your country of habitual residence, and you may bring claims before the courts of your own domicile. You may also use public alternative dispute resolution schemes for consumers.
